Terms of Service

Introduction

This Agreement, hereby referred to as the "Terms of Service" or simply "Terms", represents the entire understanding and contract between you, hereinafter referred to as the "User" or "Participant", and Riverina K9 Academy, hereafter referred to as "the Academy", "We", "Us", or "Our".

 

By initiating the enrollment process, accessing, or utilizing any services, courses, or materials provided by the Academy, you expressly acknowledge, accept, and consent to be legally bound by the stipulations, provisions, and conditions delineated herein. Such actions signify your agreement to be legally bound by these Terms.

 

Should you not concur with, or be unwilling to be bound by, any portion or the entirety of these Terms, it is imperative that you cease any further engagement and abstain from accessing or using any services, courses, or materials provided by the Academy. Continued use or engagement, post any amendment or revision to these Terms, will be considered as your renewed acceptance and agreement to be bound by the modified Terms.

 

Section 1 - Use of Services and Materials

We offer a variety of materials including articles, quizzes, videos, and other educational content (collectively, the “Materials”). Upon enrollment:

 

In accordance with this Agreement:

 

  1. The Academy confers upon the User a circumscribed, non-transferrable, and non-exclusive license to access, retrieve, and employ the Materials strictly for personal and non-commercial endeavors. This right is personal to the User and is not subject to further assignment or sublicensing.

 

  1. The User is permitted to download, store, and reference Workbook Materials solely for individual edification, provided that all intellectual property designations, copyright attributions, and other proprietary notations are preserved and remain unaltered.

 

  1. The User is expressly forbidden from disseminating, adapting, or utilizing the Materials for any commercial objectives. Any replication, redistribution, transmission, display, or derivative creation of the Materials, without obtaining explicit written consent from the Academy or as permitted by applicable copyright laws, is categorically prohibited.

 

  1. Any infraction or violation of the aforementioned stipulations will lead to the immediate and irrevocable revocation of the User’s access rights, and the Academy reserves the right to pursue any and all legal remedies available to it under applicable laws.

 

Section 2 - Intellectual Property

All right, title, and interest in and to the Website, including but not limited to its original content, features, and functionality, are the exclusive property of Riverina K9 Academy and are protected under international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

 

No part of the Program, including its content, features, or functionality, may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without the express prior written permission of Riverina K9 Academy.

 

Any unauthorized use of the intellectual property of Riverina K9 Academy is considered a breach of these Terms and may lead to termination of the User’s Account as well as legal actions including but not limited to seeking damages and injunctive relief.

 

The User acknowledges that any rights granted to them under these Terms are non-transferable and that any rights to the intellectual property of Riverina K9 Academy remain with Riverina K9 Academy , its licensors, or rights holders, as applicable.

 

Section 3 - User Representations, Warranties, and Covenants

 

In your capacity as a User of Riverina K9 Academy's services:

 

  1. You hereby represent and warrant that you have no affiliations, partnerships, employment, or other associations with entities or enterprises that are in direct competition with the Academy's dog training services. Should any such affiliations exist, you pledge to make a full disclosure to the Academy prior to commencing any formal engagement or enrollment.

 

  1. You accept and acknowledge sole responsibility and liability for all actions, behaviors, and engagements – be they direct or indirect – executed through your registered account. It remains incumbent upon you to maintain the confidentiality and security of your account credentials and to inform the Academy of any unauthorized use thereof.

 

  1. You expressly recognize and affirm the imperative of strictly adhering to all training protocols, guidelines, and methodologies presented by the Academy. Such adherence is paramount to ensuring the effective realization of training goals and outcomes.

 

Commitment to Training Protocols

Achieving desired outcomes in dog training is contingent upon unwavering commitment and consistent application. As such, it is incumbent upon all users to diligently practice, reinforce, and routinely execute the exercises, techniques, and strategies imparted during instructional sessions. Consistency and adherence to these prescribed methodologies are non-negotiable for optimal results.

 

Section 4 - Links to External Sites

Certain content, products and Services available via our Service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or Services of third-parties.

 

We are not liable for any harm or damages related to the use of goods, Services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party. Links to third-party sites are provided for convenience only. We do not endorse or assume responsibility for the content or practices of these sites.

 

Section 5 - Warranties & Refunds

  1. Warranties: The Materials and services provided by Riverina K9 Academy are presented on an "as is" and "as available" basis, devoid of any explicit or implicit warranties or representations, either statutory or otherwise. This includes, but is not confined to, implied warranties of merchantability, fitness for a specific intent, or non-infringement. 

 

  1. Content Modifications: Riverina K9 Academy reserves an unequivocal right, at its sole discretion, to make amendments, modifications, revisions, or enhancements to any content, Materials, or services, at any given time. Users are advised to routinely review content to stay abreast of any such changes. No prior notification or intimation will be furnished regarding these alterations.

 

  1. Refund Policy: Once a User has formalized their enrollment, the Academy is under no obligation to refund any fees or charges, irrespective of the circumstances. However, in exceptional cases or scenarios, the Academy may, at its sole discretion, consider providing extensions to access or a credit. Such extensions or credits are not an entitlement and will be assessed on a case-by-case basis.


  1. Payment Plans: Where a student has entered into a payment plan arrangement with us via STRIPE, these installments will be charged to the full amount over the set time arrangement regardless of a student cancelling their enrollment or having a change of mind. Where a default may occur another avenue of payment may be arranged or made available such as a tax invoice or the debit being reissued. Additional charges may apply for defaults due to administration costs via third party processing through STRIPE.

 

Section 6 - Limitation of Liability

Neither Riverina K9 Academy nor any of its subsidiaries, affiliates, officers, directors, employees, licensors, or agents shall be held responsible or liable for any direct, indirect, incidental, special, punitive, or consequential losses or damages, whether foreseeable or unforeseeable, of any kind whatsoever, arising out of or in connection with the access, use, or performance of our services or materials. This limitation applies irrespective of whether the alleged liability is based on contract, negligence, tort, strict liability, or any other basis, even if Riverina K9 Academy has been advised or should have known of the potential for such damages.

 

By using our services or accessing our materials, you expressly understand and agree to bear all risks associated with the use of said services or materials. In the event of any malfunction, disruption, or other issues resulting in a need for servicing, repair, correction, or maintenance of any equipment, software, or data, you assume all costs and responsibilities thereof.

 

Section 7 - Indemnification

You agree to indemnify, defend and hold harmless Riverina K9 Academy and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

Section 8 - Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

 

These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or when you cease using our Services.

 

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof). Furthermore, any breach of terms may lead to forfeiture of any fees or payments made to the Academy without any obligation on our part to provide a refund or compensation.

 

Section 9 - Applicable Law & Jurisdiction

These Terms are governed by the laws of the location in which Riverina K9 Academy operates. We retain the right to assign our obligations and rights under these Terms without prior notice.

 

Section 10 - Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

 

These Terms and any policies or operating rules posted by us on our platform or in respect to the Service or materials constitutes the entire agreement and understanding between you and us and governs your use of the Service and materials, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms).

 

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

 

Section 11 - Force Majeure

For the purposes of these Terms, "Force Majeure" means any event that is beyond the reasonable control of Riverina K9 Academy and shall include, without limitation, acts of God, acts of civil or military authorities, fires, floods, earthquakes, epidemics, or riots.

 

Riverina K9 Academy  shall not be liable for any failure to perform or delay in performance of any of its obligations under these Terms where such failure or delay is due to a Force Majeure event.

 

Section 12 - Changes to Terms

These Terms are effective as of the date first written above. We reserve the right to modify these terms at our discretion. Continued use post-modification indicates acceptance.

 

Section 13 - General Policies

  1. Cancellation Policy: Once a participant has formalized their enrollment into any of the programs offered by Riverina K9 Academy, the Academy is under no obligation to offer any refund or compensation in the event that the participant opts to cancel, discontinue, or withdraw from the program for any reason.

 

  1. Equipment Usage Disclaimer: Riverina K9 Academy provides recommendations and instructions related to various training equipment. However, the Academy disclaims all liability arising from the misuse, mishandling, or inappropriate application of any such equipment by clients or their representatives. It remains the client's sole responsibility to ensure the proper and safe use of all equipment. 

 

  1. Confidentiality Assurance: All communications, correspondences, and interactions with Riverina K9 Academy are deemed strictly confidential. Any information, feedback, queries, or data shared with the Academy shall not be disclosed, disseminated, or shared with third parties, unless such disclosure is expressly authorized in writing or is mandated by applicable legal provisions.

 

  1. Media Consent: By enrolling in any of the programs or services offered by Riverina K9 Academy, participants unequivocally grant the Academy, its representatives, and affiliates the irrevocable right and permission to capture, use, reproduce, and/or publish photographs, video images, or pictures of their dog(s) for promotional, advertising, educational, or any other lawful purpose without further notice or compensation.

 

  1. Severability: In the event that any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions. 

 

  1. Amendments: We may update these terms at any time, and will notify our users of any significant changes.
